1. Introduction
Welcome to Mouth To Gut ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our health tracking application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
Please read these Terms carefully before using the Service. If you do not agree to these Terms, you may not access or use the Service.
2. Important Health Disclaimer
THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
- The Service provides health tracking and AI-powered insights for informational and educational purposes only.
- Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
- Never disregard professional medical advice or delay seeking it because of something you have read or received through the Service.
- If you think you may have a medical emergency, call your doctor or emergency services immediately.
- We do not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned through the Service.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
4. Account Registration
To use certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and accept all risks of unauthorized access
- Notify us immediately of any unauthorized use of your account
- Take responsibility for all activities that occur under your account
5. Subscription and Payments
The Service is offered on a subscription basis. By subscribing, you agree to:
- Recurring Billing: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
- Payment Method: You authorize us to charge your payment method for all fees associated with your subscription.
- Price Changes: We may change subscription prices with 30 days notice. Continued use after a price change constitutes acceptance of the new price.
- Refunds: All sales are final. Subscription fees are non-refundable. You may cancel at any time to prevent future charges and will retain access through the end of your current billing period.
Payments are processed securely through Stripe. We do not store your full credit card information on our servers.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Upload malicious code or content
- Impersonate any person or entity
- Use the Service to collect information about other users
- Resell or redistribute the Service without authorization
- Use automated systems to access the Service without permission
7. AI-Powered Features
The Service uses artificial intelligence (AI) to analyze your health data and provide insights. By using these features, you acknowledge that:
- AI-generated insights are based on patterns in your data and general health knowledge, not personalized medical evaluation.
- AI responses may occasionally be inaccurate, incomplete, or not applicable to your specific situation.
- Your health data is processed by our AI provider (Anthropic) to generate insights. See our Privacy Policy for details.
- You should verify any AI-generated information with qualified healthcare professionals before making health decisions.
8. Audio Recording and Transcription
The Service includes a feature that allows you to record audio during healthcare appointments and transcribe the recording using third-party AI services. By using this feature, you acknowledge and agree to the following:
- Consent Requirement: You are solely responsible for obtaining informed consent from all parties present before initiating any recording. Many jurisdictions, including Washington State (RCW 9.73.030), require the consent of all parties to a conversation before it may be lawfully recorded. Failure to obtain proper consent may result in civil liability and criminal penalties.
- Your Responsibility: Mouth To Gut does not verify whether consent has been obtained. The in-app consent acknowledgment is a reminder of your legal obligation, not a substitute for actually obtaining consent from all recorded parties.
- Third-Party Processing: Audio recordings are transmitted to OpenAI for transcription. Transcripts may be further processed by Anthropic for summarization. By using this feature, you consent to this processing. See our Privacy Policy for details on data handling.
- No Permanent Audio Storage: Audio recordings are not stored permanently unless you have enabled cloud storage. After transcription, audio data is discarded from our servers.
- Accuracy: Transcriptions are generated by AI and may contain errors, omissions, or inaccuracies. You should review all transcripts for accuracy before relying on them. We are not responsible for any consequences arising from transcription errors.
- Indemnification: You agree to indemnify and hold Mouth To Gut harmless from any claims, damages, or legal proceedings arising from your use of the recording feature, including but not limited to claims related to unauthorized recording.
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Mouth To Gut and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any health data you input into the Service. By using the Service, you grant us a limited license to use your data to provide and improve the Service, as described in our Privacy Policy.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Mouth To Gut and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:
- Your right to use the Service will immediately cease
- You may request export of your data within 30 days of termination
- We may delete your data after 90 days unless required by law to retain it
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
